1. Acceptance of Terms

By accessing our website https://asva.co.in, requesting a quotation, placing a booking, purchasing a GPS installation, or making a payment, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions together with our Privacy Policy, Refund Policy, and other policies referenced herein. If you do not agree with any part of these Terms, you must not use our website or services.

2. Definitions

  • "Company", "we", "us", "our" means ASVA Transport Solutions (OPC) Private Limited.
  • "Customer", "you", "your" means any person or business that accesses our website or engages our services.
  • "Services" means land goods transportation (including FTL and PTL), transport brokerage, GPS/AIS-140 device supply and installation, fuel monitoring, and fleet-management solutions.
  • "Booking" means a confirmed request for a transportation or GPS service.
  • "Consignment" means the goods to be transported under a Booking.

3. Website Usage

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of, our website by any third party. You must not:

  • Attempt to gain unauthorised access to our systems, servers, or networks
  • Introduce viruses, malware, or any harmful or disruptive code
  • Copy, reproduce, or misuse website content without written permission
  • Provide false, misleading, or fraudulent information

4. Our Services

Transportation Services

We provide nationwide land goods transportation, including Full Truck Load (FTL) and Part Truck Load (PTL) movement, supported by GPS-enabled vehicles and professional drivers. Delivery timelines provided are indicative estimates and may vary based on distance, route, traffic, weather, and regulatory factors.

GPS Installation & Fleet Solutions

We supply and install AIS-140-compliant GPS devices, fuel-monitoring sensors, and provide fleet-management software and live monitoring. Installation is carried out by our technicians or authorised partners, and service availability depends on device compatibility and network/satellite coverage.

5. Bookings & Quotations

Quotations are provided based on the information you supply (such as route, load type, weight, and vehicle requirement) and are valid for the period stated in the quote. A Booking is confirmed only once we accept your request and, where applicable, the required payment or advance is received. We reserve the right to decline or cancel any Booking where information is inaccurate, goods are prohibited, or operational constraints apply.

6. Payments & Charges

  • Charges are as stated in the accepted quotation or invoice and are exclusive of Goods and Services Tax (GST) unless stated otherwise. Applicable GST will be added as per prevailing law.
  • Online payments are processed securely through the PayU payment gateway. We accept payment via credit/debit card, UPI, net banking, and wallets as supported by PayU.
  • Additional charges may apply for detention, waiting time, route deviation, multi-point loading/unloading, or services beyond the original scope, and will be communicated where possible.
  • Invoices are issued in the name of the Customer/business as provided, and GST invoices require a valid GSTIN.

7. Customer Responsibilities

You are responsible for:

  • Providing accurate consignment details, correct pickup/delivery addresses, and valid documentation (including e-way bills and invoices where required)
  • Ensuring goods are lawful, properly packed, and not prohibited or hazardous unless expressly agreed in writing
  • Making the goods available for pickup and arranging for their receipt at the destination
  • Providing a suitable and safe location and vehicle access for GPS installation
  • Making timely payment of all applicable charges

8. Liability & Limitation of Liability

We will exercise reasonable care and skill in providing our services. However, to the maximum extent permitted by applicable law:

  • We are not liable for indirect, incidental, consequential, or special losses, including loss of profit, business, or goodwill.
  • Our total liability arising out of or in connection with any Booking shall not exceed the amount of charges paid by you for that specific Booking.
  • We are not liable for loss or damage arising from inaccurate information provided by you, improper packing, inherent defects in goods, or events beyond our reasonable control.
  • GPS/telematics data is provided on a best-effort basis and its accuracy depends on network and satellite coverage; we do not warrant uninterrupted or error-free tracking.

9. Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to acts of God, natural disasters, floods, extreme weather, strikes, road blockades, riots, pandemics, government orders, regulatory restrictions, or failure of telecommunications or satellite networks.

10. Intellectual Property

All content on our website — including the ASVA name, logo, text, graphics, images, and software — is the property of ASVA Transport Solutions (OPC) Private Limited or its licensors and is protected by applicable intellectual-property laws. You may not reproduce, distribute, or use any content without our prior written consent.

11. Termination

We may suspend or terminate your access to our website or services, and cancel any Booking, if you breach these Terms, provide fraudulent information, fail to make payment, or engage in unlawful conduct. Provisions relating to payment, liability, and governing law survive termination.

12. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India, at the location of the Company's registered office.

13. Changes to Terms

We may revise these Terms and Conditions from time to time. The updated version will be posted on this page with a revised "Last updated" date, and your continued use of our website or services after such changes constitutes acceptance of the revised Terms.
